The terms of service for using the Harmon site and application.

HARMON  MEMBERSHIP AGREEMENT 

This membership agreement (the “Agreement”) sets forth the terms of your membership with Harmonbio Limited (“Harmon”). This Agreement and the services performed hereunder are designed to provide you with direct personalised medical service for the diagnosis and treatment of symptoms of menopause or andropause conditions.

Harmon has been registered by the Care Quality Commission under the Health and Social Care Act 2008 with Certificate number CRT1-14807493702. Harmon is a limited liability company registered in United Kingdom with company number 13937817. All doctors performing services for and on behalf of Harmon (the “Harmon Doctors”) are members of the General Medical Council. The “Member Care Team“ shall mean the patient care team who are fully trained to deal with the most frequently asked questions on bioidentical hormone replacement therapy.

This Agreement and the terms contained herein are entered into by and between Harmon (“we,” or “us“) and you, the user of our services (“you” or “user”). The following terms, together with Harmon’s Privacy Policy, Cookie Notice and Harmon Medical Consent Form, govern your access to and use of the services described herein, including as part of the membership plans set out at paragraph 2 (the “Services”) and including as offered on or through the My Harmon Health Portal and any pages thereof (the “Portal“), whether as a guest or a registered user. Please read the terms of this Agreement carefully before you subscribe to the Services or start to use the Portal. By beginning to, or continuing to, use our Services or access our Portal you hereby accept and agree to comply with the terms of this Agreement (including our Privacy Policy) on an ongoing basis.

Your Membership

  1. Getting started and eligibility
    To start your journey with us, we need to first assess your current hormonal status and understand if you are eligible to be a Harmon’s Member and receive Personalised Bioidentical Hormone Replacement Treatment (BHRT). It is a very simple process and consist in 2 easy steps:

    1. STEP 1: You need to subscribe to Harmon at “zero” cost and order your “Get Started Package”, that consist in an at-home hormone finger prick blood test and in an up to 45 minutes Initial Consultation with a BHRT Specialist Doctor, at a cost of £ 400.
      “Get Started Package” Summary:

      1. Subscription to Harmon at “zero” cost
      2. At-home Hormone Finger Prick Blood test
      3. Up to 45 minutes Initial Consultation with a BHRT Specialist Doctor
    2. STEP 2: The Specialist BHRT Doctor, following your blood test results and the outcome of your consultation, will confirm if you are eligible to be a Harmon’s Member and receive monthly personalised bioidentical hormone treatment (cBHRT).
      1. In case you are eligible, you will continue your subscription to Harmon and receive monthly personalised bioidentical hormone medication, plus a mandatory follow-up consultation with one of our BHRT specialist Doctor twice a year, and a follow-up blood test once per year.
      2. In case you won’t be eligible, your subscription to Harmon will be automatically cancelled at “zero” cost.
      3. In case you will be eligible but you won’t be willing to proceed with your subscription after the initial Consultation with the BHRT Specialist Doctor, you’ll have 24 hours to cancel your subscription without any charge. After that period of time, you’ll incur in a one off charge of £ 149.

      At Harmon we only treat patients who are eligible for hormone therapies, therefore in case you are unable to take hormones, we kindly invite you to discuss substitute options with your GP or other specialists outside Harmon.

  2. Prices concerns
    As a private practice we totally understand not everyone can make a choice to have private health care. Sometimes you’ve got to prioritize something else in your life and we 100% get that. We’ve all got different things going on in our families and must spend our time accordingly. In order to be able to deliver the highest quality and safety to all our patients, our service does not work for everyone’s budget. If you have decided it works for you, we would love to have you! However, the National Health Service (NHS), which provides healthcare for all UK citizens based on their need for healthcare rather than their ability to pay for it, is available for you as an alternative.   3. Memberships
    1. What’s included in your membership plan
      To the extent you are eligible to be a Harmon Member (after having had the initial hormone blood test & consultation with your Harmon Doctor), we offer you two monthly subscription options, depending on how many medications you will need: Harmon Group 1 and Harmon Group 2 (as detailed below). Our membership is set up as an annual plan with the option to pay in monthly instalments or in a single upfront payment. If you opt for the annual upfront payment, you will receive a 15% discount on the fees due. All members have the opportunity to cancel their membership at any point in their 12-month agreement, in accordance with paragraph 3(d).

      1. Membership Harmon Group 1:Monthly fee £149 (or annual fee £1520 which includes the 15% discount)
        1. One personalized bioidentical hormone medication monthly delivered to your door;
        2. A follow-up consultation (up to 20 minutes) with your Harmon Doctor twice a year;
        3. A follow-up at-home blood test once a year;
        4. 24/7 chatbot support from the Harmon team;
        5. Quick and easy access to your personal Harmon Portal to visualize, securely store, track and share your health data any time you need
      2. Membership Harmon Group 2:Monthly fee £199 (or annual fee £2030 which includes the 15% discount)
        1. Up to 3 personalized bioidentical hormone medications monthly delivered to your door;
        2. A follow-up consultation (up to 20 minutes) with your Harmon Doctor twice a year;
        3. A follow-up at-home blood test once a year;
        4. 24/7 chatbot support from the Harmon team;
        5. Quick and easy access to your personal Harmon Portal to visualize, securely store, track and share your health data any time you need.
    2. What’s not included in my membership plan
      There are some costs that are not included in your membership and will be charged by Harmon as an additional expense on the rates set out herein:

      1. Additional follow up consultations and blood tests. Harmon takes hormonal health to the next level by providing personalised hormone medications and treatment plans tailored to each person’ specific needs. For this reason, even though Harmon has created a detailed patient journey for its members (consisting of 2 follow-ups consultations and 1 follow-up blood test a year), some people may require a different pathway that will take into account their unique physiology. In this case, additional follow-ups and blood tests may be required and they will be recommended by the Harmon Doctor. Please be aware that failing to adhere to the Harmon Doctor’s instructions will compromise the results of the treatment.Costs of single medical consultations are the following:
        1. £300 for a 45-minute initial consultation
        2. £150 per 20-minute follow-up consultation

        Costs of the different types of blood test are the following:

      2. Additional bioidentical hormone medications. If you need to purchase more than 3 bioidentical hormone medications, these extra medications will be charged separately. The cost of each additional medication varies upon the type of medication, in particular:
        Harmon hormone cream 15 ml (30 doses) £120
        Harmon hormone cream 30 ml (60 doses) £ 130
        Harmon capsule (30 capsule) £ 130
        Lozenges (15 lozenges) £ 150Harmon may change and update these prices at any time at its election and shall make commercially reasonable efforts to notify you promptly before it makes such changes. All modified prices shall be effective immediately after being made available, either by way of a communication, publication upon the Portal or website or otherwise. Please always double check with the Member Care Team for updated details on prices.
      3. Screening tests. You are required to be up to date with the screening tests requested by your Harmon Doctor, to continue treatment at Harmon. Screening tests are not included in your membership and they will need to be done externally.
    3. What does “24/7 chatbot support” mean
      As a member, you have access to unlimited messaging with the Harmon Member Care Team. This does not include your Doctor. Connect with the Harmon Team anytime through the Harmon Chatbot if you have any questions between visits. For medical questions, you may need to set up a medical appointment to speak to your Harmon Doctor directly. This will be with charge.NOTE: 24/7 chatbot support is not for emergency care or services. If you require urgent medical attention, please call 999 or visit your nearest A&E department.
    4. Additional costs
      Any additional services requested beyond those set out against the relevant membership plan in this paragraph 3 may incur further cost. You hereby agree, that in the event that any further services or advice are requested outside of the relevant membership plan, Harmon reserves the right to charge further fees in accordance with paragraph 23.
  4. How can I renew my membership
    Your membership will renew every year automatically unless cancelled at least 30 days prior to the expiry of the initial annual membership. By continuing to use the Services beyond the initial period, you agree to the continuation of your membership with Harmon and we will automatically charge the appropriate fees on an ongoing basis until such membership is terminated in accordance with this Agreement. By agreeing to use the Services beyond the initial term, you hereby agree that Harmon shall charge the fees for the subsequent period automatically using the previously used payment method. In the event that you wish to change such payment method (either by way of a new credit card, or a switch to monthly billing for example) you must inform us at least 30 days prior to the expiry of the initial membership period.
  5. How can I cancel my membership
    At Harmon, our membership is set up as an annual plan with the option to pay in monthly instalments or in a single upfront payment. All members have the opportunity to cancel their membership at any point within their annual agreement. Please note that we do not offer refunds on our annual or monthly membership plans.If you make monthly payments on your membership, we will process one final membership fee per your billing cycle after requesting cancellation. You will have access to Harmon services through that billing period. For example, if you are paying £199/month, you will make one more payment of £199 while being able to utilise Harmon services until the end of that period. If you paid for your membership upfront, you will not be charged a final fee to cancel. You will have access to Harmon services through your cancellation date.
  6. Returns & Refunds
    1. Membership plans
      We do not offer refunds on our annual or monthly membership plans.
    2. Medications:
      We cannot issue refunds or accept returns of prescription products for reuse or resale, and all sales are final.
    3. Blood Tests:
      No refunds may be processed on blood tests therefore all sales are finals.

  7. Consultations
    All consultations are remote, via video or audio only. You are responsible for reserving your remote consultation session. You can book such through your “My Harmon Health Portal”. As our appointments can get booked up quite quickly, we recommend that you plan in advance if you want some choice when booking. We kindly remind you that follow-ups appointment with the Harmon Doctor are mandatory in order to continue being on hormone treatment.
  8. Rescheduling/Cancelling consultations policy
    Any cancellation of a pre-made appointment must be made at least 2 business days before such appointment. If you re-schedule or cancel a follow-up consultation with less than 2 business days, Harmon reserves the right to charge you for the full consultation fee in accordance with paragraph 3(d). Cost of an Initial Consultation (up to 45 minutes) is £ 300, while cost of a Follow-up Consultation (up to 20 minutes) is £ 150.
  9. Uploading medical documents & screening exams/medical letter reports
    You are requested to provide to your Harmon Doctor medical documents (including but not limited to: diagnostic tests report, GP letters, blood test results undertaken outside of the Harmon environment, Consultants letters, etc) by uploading them in your “My Harmon Health Portal”. Documentation will not be accepted by Harmon using any other method, including by post. Harmon will not be notified when new medical documents are being uploaded by you. Please note that documents so uploaded will not be reviewed by the Harmon Doctor on an automatic basis and if you wish to have them reviewed, you will need to schedule a follow- up appointment. The Harmon Doctor will be reviewing your medical documents directly with you at the beginning of the consultation. Please note that it is your responsibility to inform your Harmon Doctor during your appointment, about any new medical document that you have uploaded. From time to time, your Harmon Doctor may refer you to an external medical professional, for example for a screening exam or for a consultation outside of the Harmon environment. Please note that in such a case, it is your responsibility to make sure that your Harmon Doctor receives all relevant correspondence, reports or any other relevant information from that external doctor or consultant. Harmon shall suffer no liability for a failure to rely or act upon any information generated externally to the Harmon environment which has not been shared directly with Harmon by either you or your medical professional. You acknowledge that if any requested or required information is not received at the follow-up appointment (unless otherwise requested by the Harmon Doctor, for example in the case of an urgent referral request), we reserve the right to immediately terminate your Membership and we will not be responsible for any loss suffered by you as a result of such termination.
  10. Members Lateness
    You are expected to be punctual at your appointments, however we understand that sometimes circumstances can make members late for their appointments. Harmon Doctors will, as far as practicable, see Members who arrive to their online appointment late, however, please be aware that we reserve the right to reschedule your appointment and additional cost may be charged to accommodate such unless adequate notice had been provided in accordance with paragraph 8 of this Agreement.
  11. Harmon Doctor lateness
    Given the nature of our work, Harmon Doctors can on occasion be late due to assisting a previous member. Where such a delay is reasonably likely to occur, we will use our reasonable endeavours to notify you of the likely delay and where appropriate, reschedule the appointment.
  12. Blood tests
    You agree that Thriva (Blood Test Provider), its doctors and labs may process and disclose your confidential patient information in order to manage its systems and services and to provide test results, escalations, insights and reports. You understand your personal data will be managed in accordance with Thriva’s privacy notice and you agree that Thriva may disclose your confidential patient information to Harmon.
    A yearly follow-up blood test is mandatory in order to continue to use our Services. Please make sure to order and take your blood test 4 weeks prior having the follow-up appointment with your Harmon Doctor. In this way, you will be able to discuss the blood test results during your follow-up appointment. Please double check, on your personalised “Health Plan” document, sent to you by both your Harmon Doctor and the Member Care Team, at the end of your previous appointment, which is the blood test panel that you will need to order. You can order the recommended blood test through your “My Harmon Health Portal”. The blood test can be done through a Finger-prick or through a venous draw at the comfort of your home. Harmon is not responsible for any user failure to access your blood test on time or for an error in booking or receiving your blood test in accordance with our instructions. We kindly remind you that if your results won’t be available on time for your follow-up consultation on account of user delay or error, you won’t have the chance to further discuss such results with your Harmon Doctor. If you still wish to discuss your blood test results with your Harmon Doctor, a further appointment will be required with additional fees due.
  13. Can my GP complete testing ordered by Harmon
    At Harmon we handle everything for you, from at-home hormone blood test, to virtual consultations with BHRT Specialist Doctors, to the convenient delivery of personalised bioidentical hormone medication, to the storage of your own health data. Your membership plan is designed for this purpose. In addition, Harmon blood tests include specific markers that aren’t easily available through the NHS or other laboratories. For these reasons, we do not recommend that you undertake blood testing through your GP or other laboratories. Please note that if you complete your blood testing outside of the Harmon environment, no reduction in the membership fees set out herein will be offered. Please also note that if you arrive for a consultation with a Harmon Doctor with blood test results undertaken externally which are not adequate for the Harmon process (to be determined at the discretion of the Harmon Doctor), you may be required to book an additional appointment while updated blood tests are undertaken. Such additional appointment will result in an extra charge (as detailed in paragraph 3(d)).
  14. Why couldn’t my blood test results be processed or aren’t diagnostic and what to do now
    Here’s all the reasons why your sample may not have been processed or ended up being “not diagnostic”:

    1. Sample haemolysed. This means that the blood cells in the sample are damaged. It can happen if you squeeze your finger too hard during the collection process, or if you shake the sample too hard afterwards.
    2. Sample clotted. This happens if the vial was not inverted quickly after collecting the sample, or if it took too long (more than a couple of minutes) to collect the sufficient amount of blood.
    3. Insufficient sample. This means there is not enough blood. Always make sure you fill the tube to the upper line. Sometimes your sample will be marked as “insufficient” even if you filled the tubes up to the required line. This means that there was an insufficient amount of viable blood to run all of the tests in your panel. If this is the case, your sample has either clotted or haemolysed.
    4. Unlabelled or mislabelled sample. If your samples weren’t labelled, or if the label on the sample doesn’t match your return form, the lab won’t be able to process your samples. Our labs are UKAS compliant and regulated by the CQC. They need the samples to be labelled correctly so they can run the tests. Because by labelling them, you’re giving the lab permission.
    5. You didn’t post both samples to the lab. If you receive two tubes in your kit, then both need to be filled. This is because each tube tests for different things. The lab needs both of your samples to process any of your tests.
    6. LDL cholesterol results. Our labs’ blood analysers directly measure the total cholesterol level, triglycerides and HDL level. The LDL level is not directly measured using the machine, but is calculated using the total cholesterol, HDL and triglycerides, using the following formula: LDL = Total cholesterol – HDL – (triglycerides / 2.2). To calculate LDL levels, we need readings for total cholesterol, HDL, and triglycerides. Missing LDL cholesterol levels are typically due to one of the following reasons:-HDL is much more sensitive to haemolysis than total cholesterol, so it is possible to get a total cholesterol level back without an HDL level. Without the HDL level, it is not possible to calculate the LDL level.-If your Triglyceride levels are too high (over 4.5), then the formula does not work. If this is the case, it might be worth fasting overnight, and repeating the test in before breakfast as this can affect the triglyceride levels.
    7. Reason unknown. Unfortunately, sometimes the blood breaks down before the lab is able to process it. This can be due to heat, delay between collecting the sample and processing, or a number of other factors.
    8. Contamination. Contamination of the blood sample can occur if you are taking hormone medications, especially if it’s a cream or lozenges. If you use a hormone cream or lozenges there is a substantially increased chance of the sample becoming contaminated. This is because trace amounts of cream or lozenges (after touching them) remaining on the skin can mix with the sample, producing an elevated result. There are a few ways to minimise sample contamination by cream. You should wear gloves while applying the cream or taking the lozenge, it will reduce the chance of contamination. You should always thoroughly wash your hands with soap and warm water and dry them with a clean towel after applying the cream or taking the lozenge, and before taking a blood sample. To avoid the need for a retest, you may also want to consider using a trained phlebotomist to carry out the test at your home via a “venous draw”, as it can substantially reduce the risk of contamination. Please note that there is a difference in price between the finger prick and venous draw blood test as detailed in paragraph 3(b).

    What happens now?
    There can be two different situations:

    1. Blood test done ahead of your consultation with your Harmon Doctor. Your Harmon Doctor will review all of our results during your follow-up consultation and if they don’t have the majority of your results or if your blood sample has been contaminated by your hormone medication, they’ll ask for a retest, which will be automatically sent to you free of charge. We’ll email you letting you know a new test kit is on the way. To avoid the risk of your blood sample being contaminated again by your hormone medication, your Harmon Doctor may recommend you to carry out the test via a “venous draw” at your home. A trained phlebotomist will call you to arrange the appointment at the time and day that works best for you. The venous draw collecting method can substantially reduce the risk of contamination. Please note that there is a difference in price between the finger prick and venous draw blood test as detailed in paragraph 3(b).
    2. Blood test done without having a consultation with your Harmon Doctor scheduled. If you’ll receive a blood test report with some results missing or with extremely high hormone results while taking hormone medications, there is a high chance that your sample may not have been processed or ended up being “not diagnostic”, as contaminated by the hormone medication. Please get in touch with us asap by calling at +44 (0)20 4599 3550 or through our chatbot, by emailing at hello@joinharmon.com. In this last case we’ll aim to respond within 1 working day. We’ll offer you assistance helping you repeat your blood test either with the finger prick or through a venous draw. Please note that there is a difference in price between the finger prick and venous draw blood test as detailed in paragraph 3(b).
  15. Additional blood tests & follow-up consultations
    As Harmon is providing personalised treatments tailored to each person’s specific needs, even though it has created a detailed patient journey for its members, some people may require a different pathway that will take into account their unique physiology. In this case additional follow-ups and blood tests may be required and they will be recommended by the Harmon Doctor. The costs of these additional items are not part of your membership. Please be aware that failing to adhere to the Harmon Doctor’s instructions may compromise the results of the treatment.
  16. Hormone medication policy
    All of our prescribed hormone medications are dispensed by our laboratory, a GPhC-registered pharmacy which compounds bespoke hormone medications specifically for the individual patient (please refer to paragraph 18 for further information). Once dispensed, medications are sent monthly to our members by post at the address provided during the registration to the “My Harmon Health Portal”.Please note that the requirements to be on ongoing hormone treatment are:

    1. To attend regular follow-up consultations, at least twice a year, with the Harmon Doctor (or otherwise recommended by your Harmon Doctor)
    2. To attend regular follow-ups blood test at least once per year (or otherwise recommended by your Harmon Doctor)
    3. To be up to date with the screening exams requested by your Harmon Doctor.
  17. Medication policy – when not personalised bioidentical hormones or when prescribed by outside Doctors
    Harmon is not intended as a primary care physician/practitioner practice and it is not intended to take the place of your GP. Harmon Doctors will not prescribe to you any other form of medication apart from personalised bioidentical hormone medications. Please note that, in order to not interfere with treatments plans made by Doctors from outside Harmon, your Harmon Doctor won’t be able to prescribe medications coming from outside Doctors.
  18. Indications & quality of Personalised Bioidentical Hormone Replacement Therapy (BHRT):
    Harmon offers personalised bioidentical hormone treatment, for the treatment of symptoms of menopause and andropause, in case a patient needs a personalised treatment not available in the market, according to regulation 167 to the HMA 2012 (https://www.legislation.gov.uk/uksi/2012/1916/regulation/167/made) on the unlicensed use of medicine. The requirement for a “special need” relates to the special “clinical needs” of the individual patient. Harmon strictly adheres to the NICE, MHRA and to the UK Government “guidelines on off-label or unlicensed use of medicines”.     Prescribing unlicensed medicines may be necessary in the following instances:

    1. There is no suitably licensed medicine that will meet the patient’s need. Examples include – but are not limited to – where:
      1. there is no licensed medicine applicable to the particular patient;
      2. the dosage specified for a licensed medicine would not meet the patient’s need;
      3. the patient needs a medicine in a formulation that is not specified in an applicable licence.
    2. A suitably licensed medicine that would meet the patient’s need is not available. This may arise where, for example, there is a temporary shortage in supply.

    When prescribing an unlicensed medicine, all our Harmon Doctors comply with the followings and must:

    1. be satisfied that there is sufficient evidence or experience of using the medicine to demonstrate its safety and efficacy;
    2. must take responsibility for prescribing the medicine and for overseeing the patient’s care, monitoring and any fullow up treatment, or make sure that arrangements are in place for another suitable doctor to do so;
    3. make a clear, accurate and legible record of all medicines prescribed and their reasons for prescribing the unlicensed medicine.
    4. give patients sufficient information, both verbally and in written form (mandatory medical consent form) about the medicines they propose to prescribe, to allow them to make an informed decision.

    Our unlicensed prescriptions actually mean that each patient is receiving treatment that has been specifically created to treat their exact symptoms, and of course the individual hormone components are licensed. cBHRT (customised bioidentical hormone replacement therapy) offers personalised solutions for treating hormone imbalances due to menopause and andropause. Personalisation (or the compounding) of hormones follows a prescription that is based on the individual patient’s clinical needs. cBHRT uses exclusively ‘bioidentical’ hormones. These have the same structure as the body’s naturally occurring hormones, which can make them more tolerable, as they fit the same hormone receptors as our natural hormones.  cBHRT is classed as ‘unlicensed’ prescribing which is common across many healthcare sectors, including paediatrics, clinical nutrition and oncology. Prescribing unlicensed medicines is a regulated practice that is recognised and guided by the medical, nursing and pharmaceutical professional bodies. It allows different medicines to be combined in a formula that is unique to the patient’s individual prescription. At Harmon the same approved hormones used in licensed BHRT (rBHRT) are combined in a UK pharmacy registered with and regulated by the General Pharmaceutical Council (GPhC)-Registration number 9011719. The resulting hormone combination is a named-patient, prescription- specific, quality-assured extemporaneous medicine dispensed under supervision of a qualified pharmacist, as per section 10 of the Medicines Act. Harmon’s laboratory is a compounding pharmacy that adheres to all pharmacy regulations and strictly follows specific GPhC guidance and standards for dispensing unlicensed medicines. The pharmacy compounders are all trained in Pharmaceutical Science and comply with Good Manufacturing Practice (GMP), which is a UK wide industry standard. Each individual prescription is checked by a Compounding Pharmacist who will ensure that the different pharmaceutical ingredients are all compatible with each other as well as the bases they are mixed in. The preparation process is electronically tracked from beginning to end and every bespoke formulation is quality and accuracy checked against the prescriber’s prescription before being delivered to the patient. With each and every extemporaneously compounded medicine, dosing instructions are clearly stated on the dispensing label and an information leaflet containing safety information about the ingredients it contains and any potential side effects is given to the patient. Harmon’s laboratory only uses pharmaceutical-grade ingredients for hormonal preparations so that patients can be assured of the quality of their products and are regulated, registered and compliant with the General Pharmaceutical Council (GPhC) and the Medicines & Healthcare products Regulatory Agency (MHRA).

  19. Results of Personalised Bioidentical Hormone Replacement Therapy:
    We don’t know in advance how your body will react to the treatment since each person is different. This is why we work with personalized hormone medications regimes (Precision Medicine). In general, improvements are seen in 2- 6 months time (usually they start after 6 weeks), depending on how your body will react to the treatment. A safe treatment requires to start with a low dose and gradually increase it every few months, according to the results of the blood test and on the symptoms (a scientific method called “tritation”). Usually, it takes 1 year in order to achieve optimal results (the Harmon “Building Regime”phase). Optimal results may consist in clearing up all of the symptoms or, as in most cases, clearing up the majority of the symptoms and improving, by 50-70%, the remaining ones. Some members may still experience symptoms such as disturbed sleep, mood problems, difficulty in losing weight, skin issues even after reaching a perfect hormonal balance, as these symptoms might be caused by other health issues. In these cases, we recommend the help of other health care pratictioners, such as a Nutritionist, Psychotherapist, Dermatologist, Sleep Specialist. We work closely with those Specialists and we can refer our members to esteemed colleagues outside Harmon. Once your personalised treatment regime will be established, you will be in the Harmon “Ongoing Regime” phase. This phase can last years, and your treatment regime may require only small changes, in doses or type of hormones, over time, as your body’s needs change as you age.
  20. Changes in your personalised bioidentical hormone treatment regime
    Every time that your Harmon Doctor elects to make changes to your treatment regime, you may be asked to have a follow-up appointment after 2-3 months, in order for your Doctor to double check how you will be feeling on the new regime. The benefits of a new treatment regime ordinarily start to become evident after 6 weeks; this is why your follow-up should take place not earlier than 2-3 months.
  21. Screening exams referrals
    You are required to be up to date with your screening exams in order to continue your hormone treatment regime. In case you need a referral letter for a screening exam, you can contact the Harmon Member Care Team and request it anytime you need it. The referral letter will be emailed to you. Please note that you will need to book the screening exam within 1 month from the date on the referral letter.
  22. No Emergency Care; Certain Services and items excluded
    Please be advised that there are no emergencies with personalised bioidentical hormone treatment, however if you do experience any unwanted side effects out of office hours, please contact your primary care provider. If you have an emergency, you contact your local emergency services immediately. Harmon is a medical digital health service that provides exclusively the diagnosis and treatment of menopausal and andropausal symptoms and accepts no responsibility for offering emergency medical care or advice of any kind.Member Administration
  23. Fees
    Harmon may change and update prices at any time at its election and shall make commercially reasonable efforts to notify you promptly before it makes such changes. All modified prices shall be effective immediately after being made available, either by way of a communication, publication upon the Portal or website or otherwise. Please always double check with the Harmon team for updated details on prices.
  24. Doubts
    As a member, you have access to unlimited messaging with the Member Care Team (excluding your Harmon Doctor). We encourage you to connect with the Member Care Team who are fully trained and able to answer your hormonal health questions. If you wish more bespoke advice or have any complex questions which the Member Care Team are unable to answer, you will need to book a follow-up appointment with your Harmon Doctor (which will incur an additional charge as set out in paragraph 3(d)).
  25. Complaints Procedure
    You are entitled to make an official complaint if you are not fully satisfied with the treatment or service that you have received. Should you have any issue or complaint to raise then please contact the Member Care Team in the first instance by calling +44 (0) 20 4599 3550 or via email to hello@joinharmon.com. Please note that the input of any Harmon Doctor to the relevant complaints procedure shall be at the discretion of the Harmon Member Care Team who will perform the management of such procedure.
  26. Tolerance Policy
    We believe that a healthy doctor-patient relationship is based on trust and mutual respect and is the cornerstone of excellent medical care. On the rare occasion that this relationship may break down, Harmon may decide that it is in the best interests of the member that he or she finds a new practice. Equally, if a member refuses to comply with our policies, we may have no option other than to refuse any further treatment, in the interests of member safety and clinical standards. All the Harmon team play an integral role in your overall treatment at Harmon and take great pride in delivering the best possible Service. We kindly remind patients to please treat Doctors and other staff members with the mutual respect they deserve. No form of abuse, be it physical, sexual or verbal, towards any of our staff will be tolerated and will result in immediate removal from our patient base and termination of this Agreement.
  27. Returns &Refunds:
    1. Membership plans
      We do not offer refunds on our annual or monthly membership plans.
    2. Medications:
      We cannot issue refunds or accept returns of prescription products for reuse or resale, and all sales are final.
    3. Blood Tests:
      No refunds may be processed on blood tests and all sales are final.
  28. No Insurance Accepted; Self-Payment Only
    Harmon Membership is a direct health care service; it is not health insurance.  You are solely responsible for payment of all fees for Harmon’s Services. If you do have health insurance, your insurance policy is a contract between you and your insurance company. You will need to check with your health insurer to determine your level of cover. Please note that if you are covered by your insurance, your responsibility for the payment of Harmon fees remains a personal one with you and not your insurance provider. Please note that we will require you to pay Harmon in full and claim this amount from your health insurer. Any failure on the part of your insurance provider to put you in funds will not affect your legal responsibility to pay the Harmon fees as set out herein and any sums owing pursuant to this Agreement are personal to you.
  29. Subscription billing & other payments
    In case you are eligible to be a Harmon’s Member, Harmon will automatically take the payment of the first month of your membership, 24 hours after your initial consultation with the Harmon Doctor. In the event you are not eligible to be a Harmon member (at our discretion), your subscription to access the Services will be automatically cancelled at “zero” cost immediately after your initial consultation with the Harmon Doctor. In order to participate in the Harmon Membership, your Harmon Membership fee payments will be charged to your credit card on a recurring basis. You hereby agree to allow Harmon to securely store your credit / debit card information (the “Payment Method”). You authorize the Payment Method to be used automatically for your payment responsibilities to Harmon. Harmon will be using the Payment Method also for payments of single items (consultations, blood test and medications) outside of your subscription plan, when you will be placing an order for these additional items. If a credit card account is being used for a transaction, Harmon may obtain preapproval for an amount up to the amount of the payment. If you want to designate a different payment method or if there is a change in your Payment Method information, you can change the information with Harmon by messaging info@joinharmon.com. This may temporarily delay your ability to make online payments while Harmon verifies the new payment information.You represent and warrant that: (1) any credit / debit card information you supply is true, correct and complete, (2) charges you incur will be honoured by your credit/debit card company, (3) you will pay the charges incurred in the amounts posted, including any applicable taxes, and (4) you are the person in whose name the credit / debit card was issued and are authorized to make a purchase or other transaction with the relevant credit / debit card and information. You agree and authorize the Payment Method to be billed automatically in accordance with the Harmon Membership Fee Payment Schedule in an amount equal to the Harmon Membership Fee in effect for your Membership Term.  Your Membership Fee Payment Schedule is reflected in, or can be selected as part of, the Membership option you choose when you become eligible to be a Member or modify your Membership.If Harmon is unable to secure funds from your debit / credit card(s) for any reason, including, but not limited to, insufficient funds in the debit / credit card or insufficient or inaccurate information provided by you when submitting electronic payment, we reserve the right to undertake further collection action, including issuing further fees or costs associated with such collection, to the extent permitted by law and/or, where deemed appropriate, suspension of services.

    You have the right to revoke this authorization by contacting Harmon at hello@joinharmon.com at least thirty (30) days prior to the scheduled payment date. You understand that your Harmon Membership may be cancelled or as deemed appropriate, suspended if you revoke this authorization, and you remain responsible for all charges you incur or otherwise owe to Harmon Medical. This authorization will remain in full force and effect until revoked by you or Harmon Medical.

    General terms and conditions

  30. Term and Termination. Term.
    Unless terminated earlier in accordance with paragraph 4 of this Agreement, the initial term of this Agreement will be for one (1) year, beginning on the latter of the date that Harmon executes the Agreement and the date Harmon receives your initial Membership Fee payment (the “Initial Term”).  Thereafter, this Agreement will automatically renew for successive one (1) year periods (each, a “Renewal Term”), unless either you or Harmon notifies the other in writing, not less than thirty (30) days prior to the expiration of the Initial Term or the applicable Renewal Term, of the notifying party’s desire not to renew this Agreement.  In the event that we have provided you timely notice of a change in your Harmon Membership Option or Harmon Membership Fee in accordance with the terms of paragraph 3, above, then, unless you have provided notice of your desire not to renew for another Renewal Term, the change in Harmon Membership Option or Harmon Membership Fee will be incorporated into this Agreement beginning at the start of the applicable Renewal Term or upon your continued use of the Services (which you agree shall act as your agreement to the updated terms). Termination.
    Either you or Harmon may terminate this Agreement at any time, with or without cause, upon thirty (30) day’s notice. Upon notice of termination, you will be entitled to receive the services included in your selected Harmon Membership Option until the effective date of termination as detailed within this Agreement.
  31. Electronic Communications.
    By providing your phone number and email address, you agree to receive electronic communications by phone, SMS text messaging and via email and you agree to permit Harmon to identify you as a customer, including within any marketing materials.  These electronic communications may include notices about applicable fees and charges related to the Service and transactional or other information concerning or related to the Services. These electronic communications are part of your relationship with Harmon and you receive them as part of your continued use of the Service. You agree that any notices, agreements, disclosures or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing, as set out in our Privacy Policy.
  32. Licence to use the Services.
    Subject to the payment of the fees and your ongoing compliance with the Agreement, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to use the Services through the Portal, during the term of the Agreement. You shall only use the Services and the Portal in accordance with the Agreement and all applicable laws and regulations.
  33. Privacy and Confidentiality.
    Harmon will maintain a record of the services they provide to you, and will maintain the confidentiality of your medical information in accordance with applicable law. More information is available within our Privacy Policy. Harmon cannot and does not guarantee the privacy, security or authenticity of any information so transmitted over or stored in any system connected to the Services.
  34. Entire Agreement; Amendment.
    This Agreement, including the addenda and schedules hereto, sets forth the entire agreement between the parties with regard to the subject matter hereof, and supersedes all prior or contemporaneous oral or written agreements regarding the same subject matter.
  35. Liability. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND WITHOUT WARRANTIES OF ANY KIND. HARMON EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO THE SERVICES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. NO ADVICE OR INFORMATION GIVEN BY HARMON, THE HARMON DOCTORS, MEMBER CARE TEAM, ITS EMPLOYEES OR AFFILIATES SHALL CREATE A WARRANTY. YOU AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL HARMON (INCLUDING THE HARMON DOCTORS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, IMAGES, DATA OR OTHER INTANGIBLES, EVEN IF HARMON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, THAT RESULT FROM THE USE OR THE INABILITY TO USE THE SERVICES, FROM ANY CHANGES TO THE SERVICES OR FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR USER MATERIALS OR USER CONTENT. YOU ALSO SPECIFICALLY ACKNOWLEDGE THAT YOU MAY BE DISCLOSING SENSITIVE, PRIVATE AND CONFIDENTIAL INFORMATION ABOUT YOURSELF IN YOUR USE OF THE SERVICES AND YOU AGREE TO ASSUME RESPONSIBILITY FOR ANY HARM OR DAMAGES OF ANY KIND OR CHARACTER WHATSOEVER RESULTING FROM YOUR RELEASE OF SUCH USER MATERIALS OR USER CONTENT. IF YOU ARE DISSATISFIED WITH THE SERVICES OR WITH ANY OF THESE TERMS, OR FEEL HARMON HAS BREACHED THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVICES. THE TOTAL LIABILITY OF HARMON (INCLUDING THE HARMON DOCTORS) TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR USE OF SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES DURING THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY. IT IS THE INTENTION OF YOU AND HARMON THAT THIS PROVISION BE CONSTRUED BY A COURT AS BEING THE BROADEST LIMITATION OF LIABILITY CONSISTENT WITH APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF INCIDENTAL, CONSEQUENTIAL OR OTHER TYPES OF DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS AND IN PARTICULAR WITHIN THIS “LIABILITY” CLAUSE SHALL ATTEMPT TO EXCLUDE LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
  36. Updates to terms
    Harmon may change, update or review this Agreement (including any relevant fees or payment information) at any time at its election and shall make commercially reasonable efforts to notify you promptly before it makes such changes (to the extent material). All modified terms shall be effective immediately after being made available, either by way of a communication, publication upon the Portal or website or otherwise. You hereby accept and agree that your use of the Services or Portal after such changes, shall be deemed as an acceptance to the changes, without the need for any further positive action. If you do not agree to the changes, you may seek to terminate this Agreement in accordance with its terms.
  37. Intellectual property rights
    You acknowledge that all intellectual property rights, including without limitation copyrights, patents, trademarks, and trade secrets, in the Services and Portal are owned by Harmon or its licensors. Your access to or use of the Services (including the Portal) does not transfer to you or any third party any rights, title, or interest in or to such intellectual property rights. Harmon and its affiliates, licensors and suppliers reserve all rights not granted in this Agreement. You may not copy or incorporate any of the content of the Services into any work, including your own website without Harmon’s written consent. You must have a license from us before you can post or redistribute any portion of the Services. Harmon retains full and complete title to all content on the Services, including any downloadable software and all data that accompanies it. You may not modify the Services, create derivative works of the Services, or reverse engineer, reverse compile, reverse assemble or do any other operation with the Services that would reveal any source code, trade secrets, know-how or other proprietary information. Nothing in this Agreement shall be construed or interpreted as granting or providing rights to you to use, reproduce, modify, distribute, perform, display, possess or control the source code or any other aspect of the Services. You may not remove or modify any notice of confidentiality, trade secret, trademark or copyright encoded, embodied, or displayed in connection the Services. You may use the Services only while this Agreement remains in effect. Under no circumstances shall you have any rights of any kind in or to the Services after any termination or expiration of this Agreement for any reason. Harmon does not warrant or represent that your use of the Services will not infringe rights of third parties. Harmon is not responsible for any claims of ownership rights to any images or data against you. To the fullest extent permitted by law, you will indemnify, defend and hold harmless Harmon from and against any losses or claims, by an owner of data or image rights or any third party resulting from any violation of this Agreement. Certain trademarks on the Service are the service marks and trademarks of Harmon or its licensees. The domain name for the Service, the Harmon logo and elements of the design of the Portal are service marks, trademarks, logos, and/or trade dress of Harmon. All other trademarks, service marks, trade dress, product names, company names or logos, whether registered or not, on the Service are the property of their respective owners. In addition to complying with all applicable laws, you agree that you will not use any such trademarks, service marks, trade dress, or other logos from the Service without the prior written authorization of Harmon. Permission for all other uses of content, service marks, trademarks, logos, trade dress or other intellectual property contained herein, including reproducing and distributing multiple copies or using content, service marks, trademarks, logos, trade dress or other intellectual property on any other website or networked computer or linking to any page at the Service, must be obtained from Harmon or the appropriate rights owner in advance; otherwise, such use is prohibited. Requests for such authorization from Harmon should be submitted via an email to hello@joinharmon.com. All design rights, databases and compilation and other intellectual property rights associated with the Service, in each case whether registered or unregistered, and related goodwill, are proprietary to Harmon.
  38. Prohibited Use.
    Any use or attempted use of the Portal or Services (i) for any unlawful, unauthorized, fraudulent or malicious purpose, (ii) that could damage, disable, overburden, or impair any server, or the network(s) connected to any server, (iii) that could interfere with any other party’s use and enjoyment of the Service, (iv) to gain unauthorized access to any other accounts, computer systems, or networks connected to any server or systems through hacking, password mining or any other means, (v) to access systems, data, or information not intended by Harmon to be made accessible to a user, (vi) to obtain any materials, or information through any means not intentionally made available by Harmon, (vii) to reverse engineer, disassemble or decompile any section or technology on the Service, or (viii) any use other than the business purpose for which it was intended, is prohibited. In addition, in connection with your use of the Services, you agree you will not: (a) upload or transmit any message, information, data, text, software or images, or other content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, or otherwise objectionable, or that may invade another’s right of privacy or publicity; (b) create a false identity for the purpose of misleading others or impersonate any person or entity, including, without limitation, any Harmon representative, or falsely state or otherwise misrepresent your affiliation with a person or entity; (c) upload or transmit any material that you do not have a right to reproduce, display or transmit under any law or under contractual or fiduciary relationships (such as nondisclosure agreements); (d) upload files that contain viruses, trojan horses, worms, time bombs, cancel-bots, corrupted files, spyware or any other similar software or programs that may damage the operation of another’s computer or property of another; (e) delete any author attributions, legal notices or proprietary designations or labels that you upload to any communication feature; (f) use the Service’s communication features in a manner that adversely affects the availability of its resources to other users; (g) upload or transmit any unsolicited advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” “phishing” or any other form of solicitation, commercial or otherwise; (h) violate any applicable local, state, national or international law; (i) upload or transmit any material that infringes any patent, trademark, service mark, trade secret, copyright or other proprietary rights of any party; (j) delete or revise any material posted by any other person or entity; (k) manipulate or otherwise display the Service by using framing, mirroring or similar navigational technology; (l) probe, scan, test the vulnerability of or breach the authentication measures of, the Service or any related networks or systems; (m) register, subscribe, attempt to register, attempt to subscribe, unsubscribe, or attempt to unsubscribe, any party for any services or any contests, promotions or sweepstakes if you are not expressly authorized by such party to do so; (n) harvest or otherwise collect information about others, including email addresses; (o) use any robot, spider, scraper, or other automated or manual means to access the Service, or copy any content or information on the Service; or (p) assist or permit any person in engaging in any of these activities.Harmon reserves the right to take whatever lawful actions it may deem appropriate in response to actual or suspected violations of the foregoing, including, without limitation, the suspension or termination of a user’s access and/or account to the Portal or otherwise. Harmon may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong. For the avoidance of doubt and without limiting other available remedies included in this Agreement or otherwise, we may suspend your access to the Services or Portal if we have reasonable grounds to believe that you are in non-compliance with any terms of this Agreement or applicable law.
  39. Data Protection
    We will process any of your personal data (including special category data) in accordance with the terms of this Agreement, our Privacy Policy and all applicable law and regulation. In entering into this Agreement, you also confirm that you have read, agree to and make the declarations set out in Annex 1 in relation to our subcontractor, Thriva Limited.
  40. Governing Law.
    This Agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be construed pursuant to the laws of England and Wales.  The parties agree that any disputes arising out of or relating to this agreement or its subject matter shall be resolved exclusively in the courts of England and Wales, and in the courts of appellate jurisdiction therefrom. Waiver. The failure of a party to insist upon strict adherence to any term of this Agreement on any occasion shall not be considered a waiver or deprive that party of the right thereafter to that term or any other term of this Agreement. Severability. The invalidity or unenforceability of any term or provision of this Agreement shall not affect the validity or unenforceability of any other term(s) or provision(s). Notices. Any communication required or permitted to be sent under this Agreement shall be in writing and sent via electronic mail (a) to Harmon at info@joinharmon.com and (b) to you at the email or the address you designate at signature. Force Majeure Harmon shall not be in breach of this Agreement nor liable for delay in performing, or failure to perform, any of its obligations under this Agreement if such delay or failure results from events, circumstances or causes beyond its reasonable control.

Annex 1

Harmon collaborates with Thriva Limited with registered office at 6th Floor, Classic House, 174-180 Old St, London EC1V 9BP to provide you with your health services and test results. Harmon and Thriva are independent data controllers that share your personal data in the performance of the Services performed pursuant to this Agreement.

Thriva relies on your consent to process your confidential patient information, to manage their health system and services and to share confidential patient information with Harmon. In entering into this Agreement, you make the following declarations:

  1. I confirm that I am 18+;
  2. I confirm that I am placing this order for myself and not for any third party;
  3. I agree that Thriva, its doctors and labs may process and disclose my confidential patient information in order to manage its systems and services and to provide test results, escalations, insights and reports. I understand my personal data will be managed in accordance with Thriva’s privacy notice and I agree that Thriva may disclose my confidential patient information to Harmon.

Should you wish to withdraw your consent at any time please contact the Member Care Team. This will however prevent you from making continued use of the Services and may prevent you from obtaining your blood test results.
